Reporting of Human Immunodeficiency Virus (HIV), Including Acquired Immunodeficiency Syndrome (AIDS)
Texas Reporting Rules
Complete and accurate HIV/AIDS and Sexually Transmitted Disease (STD) reporting by healthcare providers and laboratories is critical in order to monitor disease burden and track changes in these diseases in Texas. Texas law mandates the reporting of HIV/AIDS and STD by both healthcare providers and laboratories and Texas Administrative Code, Chapters 97.131-97.134 specifies the reporting process for HIV/AIDS, syphilis, gonorrhea, chancroid and chlamydia. Communicable disease reporting is exempt from HIPAA (Health Insurance Portability and Accountability Act of 1996).
What to report
Lab-confirmed cases of Human Immunodeficiency Virus (HIV), including Acquired Immunodeficiency Syndrome (AIDS) must be reported to El Paso Department of Public Health (EPDPH) within seven calendar days. Especially cases of pregnancy in a person chronically infected with human immunodeficiency virus (HIV) infection, including acquired immunodeficiency syndrome (AIDS) and children associated with these cases are required to be reported.
How to report HIV/AIDS
The Texas Adult HIV/AIDS Confidential Case Report Form and the Texas Pediatric HIV/AIDS Confidential Case Report Form (<13 years of age at time of diagnosis) are the forms use to report a new HIV/AIDS case.
Do not use the Faxable S-27 form to report HIV or AIDS cases. (see form below)
The Texas Pediatric HIV/AIDS Confidential Case Report Form is used to report children less than 13 years of age with HIV infection or AIDS, or for infants that may have been perinatally exposed, but are considered HIV indeterminate due to maternal antibodies. Case report forms should be completed for each child born to an HIV infected mother (i.e. perinatally HIV exposed).
Who is required to report
Physicians, health care facilities, medical laboratories are required to report HIV/AIDS cases to the EPDPH under Texas state law.
