An arraignment hearing is when a defendant first appears before a judge for the purpose of explaining the charges against them, their rights, and hearing his/her plea of not guilty, guilty, or nolo contendere (no contest). If a defendant refuses to plea, a plea of not guilty shall be entered by the court.

A defendant may not present their testimony at the Arraignment Hearing, only proof of compliance for the charges listed. Testimonies will only be heard at trial.

The Arraignment date is located on the ticket that was issued to you by the officer.

If a defendant fails to appear to court as promised, a Pre-Warrant Hearing will be scheduled before an arrest warrant is issued. If the defendant does not appear to the Pre-Warrant Hearing an arrest warrant will be activated.

The El Paso Police Department or other law enforcement agencies can arrest someone with an active arrest warrant.

Anyone may request a 180 day payment plan, as long as you request one prior to your hearing.

If you believe you are indigent or unable to pay the fine in full, you may request an indigency hearing before the judge at 810 E. Overland.

On a case-by-case basis, the judge will determine whether or not you are indigent. The judge may grant community service in lieu of paying your fine or grant/extend a payment plan.

If you are requesting an indigency hearing but currently have an active warrant you must go in person to 810 E. Overland, El Paso Texas, 79901.

The El Paso Police Department or other law enforcement agencies can arrest you if you have an active warrant. In order to recall an arrest warrant you may:

As authorized by Chapter 706 of the Texas Transportation Code, The El Paso Municipal Court has a contract with the OmniBase Services of Texas to deny the renewal of the driver's license of a person who fails to appear for a complaint/citation or fails to pay a violation as ordered by the court.

You can visit the Texas Failure to Appear website to look up any Omni holds you may have.

In order to remove an Omni hold with El Paso Municipal Court, all warrants must be resolved and a $30 fee for each violation obtaining the Omni hold must be paid.

Once the fee is paid, it may take up to 10 days for the Texas Department of Public Safety to update the hold removal.

If you receive a hold for New Mexico or Arizona, you must wait 10 working days after your warrant has been resolved in order to request a Release Letter from the El Paso Municipal Court.

According to the Transportation Code Sec. 702.003: The County Tax Assessor may refuse to register a motor vehicle if the County Tax Assessor receives information from the El Paso Municipal Court stating that the owner of the vehicle has an outstanding warrant for failure to appear or failure to pay a fine involving a traffic violation.

El Paso Municipal Court may impose an additional $20 fee to each warrant a person has/had on a traffic violation within the last year. The additional fee is used to reimburse the County Tax Assessor for its expenses for providing the services

To find out if you have a Scofflaw hold visit the County Tax Assessor, where you register your vehicle, they will hand you an Asset Recovery Collections System (A.R.C.S) Form informing who has a Scofflaw hold on your vehicle registration.

If the El Paso Municipal Court has a Scofflaw hold you must visit any of the El Paso Municipal Court bond offices and bring the following items:

1. Vehicle Registration Renewal Notice (Current Year) or Inquiry Receipt obtained at the County Tax Assessor’s Office
2. Asset Recovery Collections System (A.R.C.S) Form
3. Copy of a State Issued Driver's License or a government issued Identification Card for all drivers listed on the registration form
4. All warrants must be resolved and any warrants resolved in the last year may have a $20.00 fee added to each violation(s).
